Services and Conditions of Use

As part of our service, we agree to provide you with information and other services that we may decide to offer, subject to the terms of this agreement. Upon notice published through the service, we may modify this agreement at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that you will be referred to as ‘customer’ in this agreement.

By using the service, you agree that you will not attempt to undermine the integrity of this web site.

Property Rights

All designs, pictures, words, logos and other content contained within this website is the property of Winoship Ltd or is used by Winoship Ltd under licence and shall not in any way be copied, reproduced, transmitted or duplicated unless as a means of placing an order with us without the express written permission of Winoship Ltd. Nothing in these terms shall be deemed to have transferred or consigned any rights concerning such content to any user.

Age Restrictions

It is against the law for any person aged under 18 years of age to buy or attempt to buy alcohol and Winoship Ltd are committed to holding up their legal responsibilities. In purchasing alcohol from us you confirm that you are at least 18 years of age and we reserve the right to perform checks during the purchase process or at point of delivery to ensure you are at least 18 years of age when purchasing alcohol.

Delivery

Our delivery service covers the entire mainland United Kingdom.
We will endeavour to deliver the goods within 3 – 5 working days during normal working hours on Monday to Friday. If however, this delivery period is not suitable, arrangements can be made for an alternative day or time at extra cost.
Independent carriers are used for all deliveries. They will attempt to deliver the goods twice, after which time arrangements must be made directly with them for a convenient delivery day at your expense. If the delivery has not been successful within 7 days, then the goods will be returned to our warehouse. In the event that we are given instruction to leave wines the risk of damage or loss passes to the purchaser on compliance with the specified instructions.

Prices

All our prices are inclusive of VAT at POS.

Availability

All products and other items are subject to availability. Occasionally we will substitute wines for those of a different vintage, where these are of equal or greater value. Where a product is out of stock we will make every effort to offer an alternative product or to provide a reasonable estimate of when the product will return to stock.

Mixed Cases

We reserve the right to change the contents of any pre-mixed case of wine. In the event that any wine within a pre-mixed case becomes out of stock, we may substitute the wine shown for an alternative of similar or higher value.

Faulty Products

We will provide a full refund of any wines that are faulty. This does not affect your statutory rights.
Faulty bottles may be required to be returned to us and we will arrange this as necessary at your convenience.

Breakages

If any bottles are damaged or broken the carrier will normally not deliver the case and a replacement case will be despatched, at no additional cost, as soon as possible. We will keep you advised on the status of your order. If a breakage is found after delivery please contact us immediately. Please wherever possible retain the original packing.

Substitutions

There may be occasions when one of our wines is temporarily out of stock – we will offer you an alternative of equal value which you can accept or decline. It is possible that the vintage indicated on the web site is no longer available and if this happens we will offer you the vintage which we have in stock. You can accept or decline the replacement vintage or an equivalent value and quality alternative. In either eventuality we will keep you fully informed.

There are some products on the website which are not vintage specific. For these products you may receive mixed vintages if you have ordered more than one bottle.

Wineries occasionally change the name and/or labelling of certain wines without notification. Wherever possible we will supply you with the wines as shown on our website but this may not always be possible.

Cancellations and Complaints

Any order may be cancelled but any cancellation must take place within 14 working days from date of delivery. Should you decide to cancel, all charges to you will be refunded as soon as the goods are returned in merchantable condition.

In the event of complaint, please contact us directly giving as much detail of your complaint as possible. All complaints will be acknowledged within 2 working days and we will endeavour to resolve the matter as soon as possible.

Privacy Statement

Where you have been directed to our site from a third party’s website, we may pass your details back to the introducing firm. You agree that the information we or the third party holds about you can be held on computer and/or paper files. You agree that any information which you give us may be disclosed to these third parties for the purpose of contacting you from time to time by post, fax, e-mail or telephone to bring to your attention additional products or services the third party may be able to provide.

Re-Sale

All items purchased via our website are for personal use and shall not be sold on in any way whatsoever.

Fraud and Crime Prevention

We reserve the right to share any information we may collect with the police or other legislative bodies in accordance with relevant legislation for the purposes of detection of offences or the apprehension or prosecution of offenders.

Liability

All images used on this website are for illustrative purposes only and whilst every effort is made to ensure accuracy, no liability is assumed by Winoship Ltd in the event that product colours etc. do not match illustrations. Any product descriptions are made by us for general guidance or by winemakers or other suppliers and whilst all care is taken to ensure accuracy we make no warranties as to this site or its contents and do not accept liability for any alternative views or opinions regarding products contained within this website. Any links contained within this website to alternative websites are made for your convenience and we do not accept any liability or obligation for information contained on other websites. Our liability for any losses incurred by you as a result of us breaching the terms of sale are limited strictly to any losses that are foreseeable and reasonably incurred. We are not liable for any delay or failure to perform our obligations arising from any cause outside of our control, including but not limited to acts of God, governmental acts, wars, fires, floods, adverse weather conditions, industrial action, failure of technology or telecommunications or any failure by any third party to perform its obligations. We are not liable for any loss or damage caused by the customer handling wine or other goods and in particular are not responsible for any breakages or spillages, or damage caused to other property as a result of such. Care should be taken when lifting heavy items such as boxes of wine and care should be taken when handling or opening sparkling wine, which can be volatile due to a build up of gasses. Alcohol should always be consumed in moderation. Nothing within these conditions shall affect any statutory or civil or legal rights under law.

We reserve the right to amend these terms and conditions in full or in part at any time and without notice providing such amendment does not constitute a breach of any legal obligation or law
